Common use of Misstatement of Essential Data Clause in Contracts

Misstatement of Essential Data. If it has been found that any essential data pertaining to any person has been omitted or misstated, including, but not limited to, a misstatement as to the age of an annuitant, an equitable adjustment shall be made as soon as possible so as to provide the annuity to which that person is entitled. Any discovered underpayment by AUL resulting from such omission or misstatement of essential data shall be made up immediately.
