Common use of Mitigation of Delay Event Clause in Contracts

Mitigation of Delay Event. If Access Right Holder is affected by a Delay Event, then Access Right Holder must use best endeavours (including by incurring reasonable costs) to mitigate the effect of that Delay Event and Access Right Holder’s performance of its obligations under this agreement affected by the Delay Event as soon as is reasonably practicable.
