Common use of Modification of Automatic Stay Clause in Contracts

Modification of Automatic Stay. The automatic stay imposed under Bankruptcy Code section 362 is hereby modified and lifted to the extent necessary to effectuate the terms of this Final Order and the DIP Facility Documents.

Modification of Automatic Stay. The automatic stay imposed under section 362(a) of the Bankruptcy Code section 362 is hereby modified as necessary to (a) permit the Debtors to grant the DIP Liens and lifted to incur all liabilities and obligations to the extent necessary to effectuate Lender under the terms of DIP Loan Documents and this Final Order Order, and (b) authorize the DIP Facility DocumentsLender to retain and apply payments hereunder.

Modification of Automatic Stay. The automatic stay imposed under provisions of Section 362 of the Bankruptcy Code section 362 is are hereby modified and lifted vacated as to the Lender to the extent necessary to effectuate permit the terms of Lender at its option to, as appropriate, (a) file any financing statements or other instruments and documents, if any, evidencing their security interests provided in this Final Order Interim Order; and the DIP Facility Documents(b) to charge any fees as provided in paragraphs 4 and 7.
