Common use of Modifications (Extra Work) Clause in Contracts

Modifications (Extra Work). If, during the performance of the Contract, it shall become necessary or desirable for the proper completion of the Work to order modifications to the Work or material furnished, which are not susceptible to classification under the schedule of prices Bid, the Contractor shall, if authorized in writing by the Engineer, approved by the Director of the Department of Public Services or his/her designee and if signed by the Director of Purchasing or his/her designee, do and perform such Work and furnish such materials. The Engineer shall order the Contractor to complete the work and an equitable adjustment will be authorized as provided in Subsection 103.08, titled “Pricing Adjustments.”
