Common use of MORTGAGEE'S APPROVAL Clause in Contracts

MORTGAGEE'S APPROVAL. Landlord's obligation to perform its covenants and agreements hereunder is subject to the condition precedent that this Lease be approved by the holder of any mortgage of which the Premises are a part and by the issuer of any commitment to make a mortgage loan which is in effect on the date hereof. Unless Landlord gives Tenant written notice within thirty (30) business days after the date hereof that such holder or issuer, or both, disapprove this Lease, then this condition shall be deemed to have been satisfied or waived and the provisions of this Section 8.7 shall be of no further force or effect.

Unless Landlord gives Tenant written notice within thirty ten (3010) business days after the date hereof that such holder or issuer, or both, disapprove this Lease, then this condition shall be deemed to have been satisfied or waived and the provisions of this Section 8.7 shall be of no further force or effect. Should this Lease not be approved by such mortgagor, Tenant shall have the right to terminate this Lease without incurring any liability to Landlord.

Unless Landlord gives Tenant written notice within thirty fifteen (3015) business days after the date hereof Date of Lease Execution set forth on page 3 of this Lease that such holder or issuer, or both, disapprove this Lease, then this condition shall be deemed to have been satisfied or waived and the provisions of this Section 8.7 shall be of no further force or effect.

MORTGAGEE'S APPROVAL. Landlord's obligation to perform its covenants and agreements hereunder is subject to the condition precedent that this Lease be approved by the holder of any mortgage of which the Premises are a part and by the issuer of any commitment to make a mortgage loan provide permanent financing which is in effect on the date hereof. Unless Landlord gives Tenant written notice within thirty (30) 15 business days after the date hereof that such holder or issuer, or both, disapprove disapproves this Lease, then this condition shall be deemed to have been satisfied or waived and the provisions of this Section 8.7 8.4 shall be of no further force or effect.
