Name of Hotel. Subject to compliance with any requirements of the Franchise Agreement, the name of the Hotel shall be selected by Owner in its sole and absolute discretion and may be modified by Owner in its sole and absolute discretion. Owner recognizes that Operator has experience in naming and marketing of hotels and will consult with Operator before changing the Hotel name, but the final decisions on the name of the Hotel and any change in the name shall be that of Owner in its sole and absolute discretion.
Name of Hotel. Subject to Section 2.13.2, the Hotel shall be operated under the name specified in the Term Sheet. If Manager and its Affiliates change the Brand Name, the Hotel name shall be changed, at Manager's expense, without Owner's consent, to reflect the change in the system-wide identification. The Brand Name and any replacement or substitute name constitutes a distinctive hotel service mark for use in connection with the Hotel.
Name of Hotel. Lessee will not change the name of the Hotel without the prior written consent of Lessor, which consent shall not be unreasonably withheld.
Name of Hotel. The Hotels shall be known by such names as shall be determined by Owner. The provisions of this Section 11.5 shall be suspended at all times during which the License Agreement is in effect.
Name of Hotel. During the Term, the Hotel shall at all times be known as a “Days Inn” or a "Days Hotel”, or such other name as may be selected by Owner.
Name of Hotel. Manager shall operate the Hotel under the name “Omni Dallas Convention Center Hotel”. Any change in the name of the Hotel by Manager shall be approved by Owner, City and Trustee, in writing; provided, however, that any such name, of the Hotel shall include the name “Omni”; provided further if Manager and its Affiliates change the brand name used in the system-wide identification of the Other Omni Hotels, the Hotel name may be changed, at Manager’s expense, without Owner’s consent, to reflect the change in the system-wide identification, provided, that if the system-wide identification, as changed, is no longer generally known as an upscale hotel brand or a hotel having a Four Diamond rating with respect to operating standards, then Owner may terminate this Agreement by delivering written notice thereof without payment of any Termination Payment. If at any time the brand name “Omni” is no longer generally known as an upscale hotel brand or having a Four Diamond rating with respect to operating standards, then Manager shall operate the Hotel under another comparable hotel brand operated by Manager or its Affiliates that is generally known as an upscale hotel brand or a hotel having a Four Diamond rating with respect to operating standards; provided, however, the foregoing shall not affect Manager’s obligation to manage the Hotel under the Operating Standard. If Manager fails so to operate the Hotel under another hotel brand acceptable to Owner, then Owner may terminate this Agreement by delivering written notice thereof to Manager and no Termination Fee shall be payable to Manager hereunder.
Name of Hotel. The name of the Hotel initially shall be: Sonesta Hotel & Suites, Coconut Grove. Operator shall have the right to change such name, or the name of any portion of the Hotel, from time to time, subject to Owner's prior approval, which shall not be unreasonably withheld.
Name of Hotel. At all times during the Operating Term, the Hotel will be operated under the "HILTON" brand and the name of the Hotel will continue as the "Hilton Austin" or any other name mutually agreed upon by Manager and Corporation. If Manager and its Affiliates change the brand name used in the system-wide identification of the Other Hilton Hotels, the Hotel name may be changed, at Manager's expense, without Corporation's consent, to reflect the change in the system-wide identification, provided, that if the system-wide identification, as changed, is no longer generally known as an Upper Upscale Hotel brand, then Corporation may terminate this Agreement by delivering written notice thereof without payment of any Termination Fee. If at any time the brand name "HILTON" is no longer generally known as an Upper Upscale Hotel brand, then Manager shall consider operation of the Hotel under another comparable hotel brand operated by Manager or its Affiliates that is generally known as an Upper Upscale Hotel brand, or the highest name brand that is not a luxury collection brand; provided, however, the foregoing shall not affect Manager's obligation to manage the Hotel under the Operating Standard. If Manager fails to operate the Hotel under another hotel brand acceptable to Corporation, then Corporation may terminate this Agreement as its sole remedy by delivering written notice thereof to Manager and no Termination Fee shall be payable to Manager hereunder.
Name of Hotel. Section 13.1 of the Agreement is hereby amended by deleting the words “the Hotel Condominium and the other aspects of” and inserting after the word “Project” the following parenthetical “(other than the Hotel”).”
