Common use of Network Rail Notice to Terminate Clause in Contracts

Network Rail Notice to Terminate. 8.3.1 Any notice of termination served by Network Rail under Clause 8.2 shall not take effect if the Adjacent Facility Owner has , after the date of service of any notice of termination and before the date of that notice taking effect, applied to the Office of Rail and Road under section 17 of the Act for directions to be given to Network Rail to enter into an access contract which provides for the continued connection of the Adjacent Facility to the NR Network and for so long as that application shall not have been refused.
