Common use of No Breach of Obligations Clause in Contracts

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (i) Force Majeure Event, subject to Article 11.1; (ii) Authority Event of Default; (iii) Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this the Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this the Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.15.3; (ii) Authority Event of Default; (iii) Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.1;, (ii) Authority Event of Default; (iii) b. Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence /court/tribunal/government agency; c. Closure of a breach by the Concessionaire Project Facility or part thereof with the approval of any of its obligations hereunder;the Authority.

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this the Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this the Agreement is affected by or on account of any of the following: (ia) Force Majeure EventEvents, subject to Article 11.110; (iib) Authority The Authority’s Event of Default; (iiic) Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency Agency, other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;; and (d) Closure of the Project Installations, or part thereof, with the approval of the Authority.

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.1ARTICLE 14; (ii) b. the Authority Event of Default; (iii) c. Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence /court/tribunal/government agency; d. Closure of a breach by the Concessionaire Project Facility or part thereof with the approval of any of its obligations hereunder;the Authority.

No Breach of Obligations. 4.17.1 The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.19; (ii) b. the Authority Event of Default; (iii) c. Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder; d. Closure of the Project Facility or part thereof with the approval of the Authority.

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (ia) Force Majeure Event, subject to Article 11.112.3; (iib) Authority ULB Event of Default; (iiic) State Government Event of Default; (d) Compliance with the instructions of the PMU/ Authority Construction Supervisor / Independent Engineer /ULB or the directions of any Government Agency other than Agency. Provided that the instructions should not have been issued as a consequence of a breach by the Concessionaire of any of its obligations hereunderunder this Agreement; (e) Closure of the Project Facilities or part thereof with the approval of the ULB.

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its it s obligations under this the Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this the Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.1Art icle 5.3; (ii) b. Concessioning Authority Event of Default; (iii) c. Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency Agency, other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;; and d. Closure of the Project or part thereof with the approval of the Concessioning Authority.

No Breach of Obligations. The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (i) a. Force Majeure Event, subject to Article 11.110; (ii) Authority b. CoC Event of Default; (iii) c. Compliance with the instructions of the PMU/ Authority Project Officer / CoC or the directions of any Government Agency other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;.

The Concessionaire shall not be considered to be in breach of its obligations under this Agreement nor shall it incur or suffer any liability if and to the extent performance of any of its obligations under this Agreement is affected by or on account of any of the following: (ia) Force Majeure Event, subject to Article 11.15.3; (ii) Authority Event of Default; (iii) Compliance with the instructions of the PMU/ Authority or the directions of any Government Agency other than instructions issued as a consequence of a breach by the Concessionaire of any of its obligations hereunder;
