Common use of No Demand and Effect of Payment Clause in Contracts

No Demand and Effect of Payment. All sums relating to this Agreement shall be due without prior notice or demand except when notice is necessary to make Tenant aware of the amount due if such amount is not otherwise set forth in this Agreement. Tenant shall make all payments without set-off or deduction. All sums paid by Tenant shall first be applied to any past due rent beginning with the most recent amount due. No statement on any check or elsewhere shall be deemed to create an accord and satisfaction. City may accept any payment without prejudice to City's rights to recover any sum or pursue other remedies provided by this Agreement or by law. City’s billing or acceptance of prepaid rent for time periods beyond the Expiration Date or Termination Date of this Agreement shall not serve to extend this Agreement nor Tenant’s right to occupy the leasehold, notwithstanding any claim Tenant may have for refund of prepaid rent.
