No Excused Performance. In the event Buyer fails to provide any notice that Buyer is required to deliver pursuant to Section 5.4, or otherwise fails to provide any other notice or take any other action necessary to give effect to the purposes of Section 5.4, Buyer shall nevertheless be obligated to pay such amount that covers payment for the total quantities of Offtake Products required to be paid for by Buyer in accordance with Section 5.4 and Section 5.8, regardless of whether or not Buyer ever intends to take or actually takes delivery of such Offtake Products.
