Common use of No Interest in Land Clause in Contracts

No Interest in Land. (a) Project Co acknowledges and agrees that, subject to the provisions of the CLA, in accordance with the principles of the IPFP Framework, neither Project Co nor the Lenders shall acquire any estate, right, title or ownership interest in the Site, the Facility or the Existing Facilities or any other interest in land pursuant to this Project Agreement, the Project Documents or otherwise. Notwithstanding any provision herein or in any of the Project Documents to the contrary, all fee simple interest in and freehold title to the Site, or any part thereof, and the Project, shall at all times remain unencumbered by any interest of Project Co or the Lenders. Project Co and the Lenders shall have access to the Site, the Facility and Existing Facilities under and subject to the licences and access rights granted under this Article 16 and the Lenders’ Direct Agreement, respectively.

Project Co and the Lenders shall have access to the SiteSites, the Facility Facilities and Existing Facilities under and subject to the licences and access rights granted under this Article 16 and the Lenders’ Direct Agreement, respectively.
