No Leases. Notwithstanding anything to the contrary in the Basic Documents, none of the Initial NH Receivables or the Subsequent NH Receivables shall be Leases.

Seller agrees to indemnify, defend, and hold harmless Buyer, its officers, elected officials, employees, agents, contractors, and assigns, from and against any and all damage, claim, liability, or loss, including reasonable attorney's and other fees, arising out of or in any way connected with leases, licenses, or other occupancy agreements or contracts affecting the Property as of the date of mutual execution of this Agreement.
No Leases. There are no commercial, farm, or other leases applicable to or affecting the Property and no parties in possession or adverse possession of the Property. To the extent that any such leases exist, Seller shall obtain a termination thereof prior to the Feasibility Expiration Date.
