The Neither Tenant’s voluntary or other surrender of this Lease, nor the parties’ mutual termination or cancellation of this Lease, nor a termination of this Lease by Landlord for a default by Tenant or a mutual termination thereof under this Lease, shall not work as a merger with any Sublease, and shallLandlord may, in the event of any such occurrence, elect, at its sole option, by written notice to the option of Landlordsubtenant or subtenants, either (a) terminate or assume, as the landlord, all or any then-existing subleases, or (b) operate as an assignment to Landlord of Tenant’s interest under any or all such subleasesSubleases.

The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual cancellation thereof, or a termination thereof by Landlord, shall not work as a merger merger, and shall, at the option of Landlord, either (a) terminate all or any existing subleasessubtenancies or may, or (b) at the option of Landlord, operate as an assignment to Landlord of Tenant’s interest under any or all of such subleasessubtenancies.

No Merger. The voluntary or other surrender of this Lease by Tenant or a mutual cancellation of the Lease or a termination thereof shall by Landlord will not work as a merger and shallwill, at the option of Landlord, either (a) terminate all or of any existing subleasessub-tenancies or may, or (b) at the option of Landlord, operate as an assignment to Landlord of Tenant’s interest under any or all such subleasessub-tenancies.

No Merger. The voluntary or other surrender of this Lease by Tenant Tenant, the mutual cancellation thereof or a mutual the termination thereof shall not work of this Lease by Landlord as a merger and result of an event of default by Tenant shall, at the option of Landlord, either (a) terminate all or any existing subleasessubtenancies or may, or (b) at the option of Landlord, operate as an assignment to Landlord of Tenant’s interest under any or all of such subleasessubtenancies.

No Merger. The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual termination thereof cancellation thereof, shall not work as a merger merger, and shall, at the option of Landlord, either (a) Landlord shall terminate all or any existing subleasesAssignments or Subleases, or (b) at the option of Landlord may operate as an assignment to Landlord of Tenant’s interest under any or all Assignments or Subleases. Furthermore, any foreclosure of a mortgage that may be held by a Tenant on the Land and/or the Premises shall not work a merger, and in such subleasesinstance, the Lease hereunder shall remain in full force and effect.

No Merger. The voluntary or other surrender of this Lease by Tenant or a mutual termination thereof cancellation of this Lease shall not work as a merger and shall, at the option of Landlord's option, either (a) terminate any ro all existing subleases or any existing subleasessubtenancies, or (b) operate as an assignment to Landlord of Tenant’s interest under any or all of such subleasessubleases or subtenancies.

No Merger. The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual termination thereof cancellation thereof, shall not work as a merger and shall, at the option of Landlord, either (a) terminate all or any existing subleases, or (b) operate as an assignment to Landlord of Tenant’s interest under any or and/or all such subleasessubleases of subtenants.

No Merger. The Tenant’s voluntary or other surrender of this Lease by Tenant Lease, or a mutual termination thereof shall the parties’ cancellation of this Lease, will not work as a merger and shallmerger, but will, at the option of Landlord’s option, either (a) terminate all or any existing subleasessubleases or subtenancies, or (b) operate as an assignment to Landlord of Tenant’s interest under any or all such subleasessubleases or subtenancies. Notwithstanding the foregoing, Tenant acknowledges that it does not have the right voluntarily to surrender the Premises.

No Merger. No Merger. No Merger. The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual termination thereof cancellation hereof, shall not work as a merger of this Lease, unless Landlord otherwise elects, and shall, at the option of Landlord, shall either (a) terminate any or all existing sublease or any existing subleasesconcessions, or (b) operate as an assignment thereof to landlord, whichever Landlord of Tenant’s interest under any or all such subleasesshall elect.

No Merger. The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual cancellation of this Lease, or a termination thereof shall by Landlord, will not work as a merger merger, and shallwill, at the option of Landlord, either (a) terminate all or any existing subleasessubleases or may, or (b) at the option of Landlord, operate as an assignment to Landlord of Tenant’s interest under any or all such subleases.

The voluntary or other surrender of this Lease by Tenant Tenant, or a mutual termination thereof cancellation thereof, shall not work as a merger merger, and shall, at the option of Landlord, either (a) terminate all or any existing subleases, or (b) operate as an assignment to Landlord it of Tenant’s interest under any or all such subleasessubleases or sub tenancies.

The To the extent permitted by Law, the voluntary or other surrender of this Lease by Tenant Tenant, a mutual cancellation of this Lease, or a mutual termination thereof by Landlord shall not work as cause a merger merger, and shall, at the option of Landlord, either (a) terminate all existing subtenancies or any existing subleasesmay, or (b) operate as at the option of Landlord, cause an assignment to a Landlord of Tenant’s interest under any or all such subleasessubtenancies.

No Merger. The voluntary or other surrender of this Lease by Tenant or Tenant, a mutual cancellation of -this Lease, or the termination thereof of this Lease by Landlord pursuant to any provision contained herein, shall not work as a merger and shallmerger, but, at the option of Landlord’s option, shall either (a) terminate any or all or any existing subleasessubleases hereunder, or (b) operate as an assignment to Landlord of Tenant’s interest under any or all such subleases.
