No Non-Monetary Consideration for Sales. Without the prior written consent of PROGENICS, BMS and its Affiliates and Sub-sublicensees shall not accept or solicit any non-monetary consideration in the sale of Licensed Products other than as would be reflected in Net Sales. The use by BMS and its Affiliates and Sub-sublicensees of commercially reasonable amounts of Licensed Products for clinical trials and promotional sampling shall not violate this provision.
No Non-Monetary Consideration for Sales. Without the prior written consent of the Company, ERS and its Affiliates shall not accept or solicit any non-monetary consideration of the sale of the Products. Subject to the applicable oversight and approval responsibilities of the PDC and the JCC set forth in Sections 2.3(b)(vii) and 2.4(b)(vii), the use by ERS and its Affiliates of a commercially reasonable amount of the Products for promotional sampling, compassionate use and indigent care shall not violate this Section 7.7.

Without the prior written consent of Inspire, Santen, its Affiliates and its Sublicensees shall not accept or solicit any non-monetary consideration of the sale of the Product other than as would be reflected in Net Sales. The use by Santen, its Affiliates and its Sublicensees of a commercially reasonable amount of Product for promotional sampling shall not violate this Section 7.6.

Without the prior written consent of Inspire, Kissei and its Affiliates and Sublicensees shall not accept or solicit any non-monetary consideration of the sale of the Product other than as would be reflected in Net Sales. The use by Kissei and its Affiliates and Sublicensees of a commercially reasonable amount of Product for promotional sampling shall not violate this Section 7.6.
No Non-Monetary Consideration for Sales. Neither Party shall accept or solicit any non-monetary consideration in the sale of any Licensed Product or products, other than as would be reflected in the calculation of Net Sales. The use by a Party of commercially reasonable amounts of Licensed Products or products for promotional sampling shall not violate this prohibition.
No Non-Monetary Consideration for Sales. Without the prior written consent of Sano, BMS and its Affiliates and Sub-Distributors shall not accept or solicit any non-monetary consideration in the sale of the Product other than as would be reflected in Net Sales, except for such quantities of sample goods of Products provided to BMS by Sano pursuant to Section 3.8.

Without the prior written consent of Inspire, Allergan, its Affiliates and its licensees shall not accept or solicit any non-monetary consideration of the sale of the Restasis products other than as would be reflected in Net Sales. The use by Allergan, its Affiliates and its licensees of a commercially reasonable amount of the Restasis products for promotional sampling shall not violate this Section 5.6.
No Non-Monetary Consideration for Sales. Without the prior written consent of Alteon, Genentech and its Sublicensees shall not accept or solicit any non-monetary consideration for the sale of Licensed Products other than as would be reflected in Net Sales, except for such quantities of sample goods of Licensed Products.

Without the prior written consent of ALTEON, CIL and its Affiliates and sublicensees shall not accept or solicit any non-monetary consideration in the sale of any Product other than as would be reflected in Net Sales. The use by CIL of a commercially reasonable amount of Product for promotional sampling shall not violate this prohibition.
No Non-Monetary Consideration for Sales. Without the prior written consent of Arris, BMS shall not accept or solicit any non-monetary consideration in the sale of a Collaboration Product other than as would be reflected in Net Sales, except for clinical studies and customary promotional samples.
