No Rights Created by Xxxxxx. ‌ Ownership of the Tokens carries no rights, express or implied, other than the right to use the Tokens as specified in this Agreement In particular, the Tokens: • do not provide Buyer with rights of any form with respect to any of the MY PLACE X Team or its revenues or assets, including any voting, distribution, redemption, liquidation, proprietary (including all forms of Intellectual Property), or other financial or legal rights; • do not represent a loan to someone from the MY PLACE X Team; Acquisition of the Tokens from MY PLACE X does not present an exchange of payment (only Cryptocurrencies are used and Fiat Currencies are always excluded) for any form of shares in any of the MY PLACE X Team or Spot-X or the Intellectual Property. In order to avoid any doubt and irrespective of the provisions of the White Paper, Buyer is not entitled to any guaranteed form of dividends, revenue distributions, and voting rights. For the purpose of this Agreement, the Tokens shall be viewed as software with cryptographic elements that is sold out as a utility appliance for the Platform. MY PLACE X may from time to time launch various incentive programs, including the one specified in the Agreement, for the holders of the Tokens to encourage and promote their attention to the Platform.

  • Exercise of Rights No failure or delay on the part of any party to exercise any right, power or privilege under this Agreement and no course of dealing between the Seller and the Purchaser shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power or privilege under this Agreement preclude any other or further exercise thereof or the exercise of any other right, power or privilege. Except as set forth in Section 6(h) of this Agreement, the rights and remedies herein expressly provided are cumulative and not exclusive of any rights or remedies which any party would otherwise have pursuant to law or equity. No notice to or demand on any party in any case shall entitle such party to any other or further notice or demand in similar or other circumstances, or constitute a waiver of the right of either party to any other or further action in any circumstances without notice or demand.
