No Violation of Covenants. Tenant covenants and agrees not to commit, suffer or permit any violation of any covenant, condition or restriction affecting the Demised Premises or the Property.
No Violation of Covenants. To the Knowledge of the Company, no event of default has occurred and is continuing (or event which with the lapse of time or notice or both would constitute such an event) which has not otherwise been waived under any revolving credit facility, indenture, mortgage, deed of trust, loan agreement or other agreement or instrument for money borrowed or any other material agreement to which the Company or any of its Subsidiaries is bound, or to which any of the property or assets of the Company or any of its Subsidiaries is subject, and in any case, which the failure to cure or obtain a waiver with respect to such default would have a Material Adverse Effect.

No material event of default has occurred and is continuing (or event which with the lapse of time or notice or both would constitute such an event) which has not otherwise been waived under any revolving credit facility, indenture, mortgage, deed of trust, loan agreement or other agreement or instrument for money borrowed or any other material agreement to which the Company or any of its Subsidiaries is bound, or to which any of the property or assets of the Company or any of its Subsidiaries is subject.

No Violation of Covenants. Upon Closing, the transfer of the Assets to Buyer will not violate any covenants or restrictions imposed on Seller by any bank or other financial institution in connection with a mortgage or other instrument, and will not result in the creation or imposition by or on account of Seller of a lien on any portion of the Assets.
No Violation of Covenants. Tenant covenants and agrees not to commit, suffer or permit any violation of any covenants, conditions or restrictions affecting the Premises or the Property, as they may be amended from time to time provided such amendment does not prohibit or materially interfere with Tenant's use of the Premises as set forth herein. A copy of the Restrictive Covenants is attached hereto as Exhibit K and incorporated herein by reference.

No event of default has occurred ------------------------- and is continuing (or event which with lapse of time or notice or both would constitute such an event) which has not otherwise been waived under any of the revolving credit facilities or under any indenture, mortgage, deed of trust, loan agreement or other agreement or instrument for money borrowed or any other material agreement to which the Company or any of its subsidiaries is bound, or to which any of the property or assets of the Company or any of its subsidiaries is subject. The Company shall have fifteen (15) Trading Days after the end of a fiscal quarter during which to cure or obtain the waiver of any default that has occurred and is continuing during an Investment Period with respect to the minimum Tangible Net Worth covenant under the terms of the Revolving Credit Agreement, and the Investor hereby acknowledges that the Company shall not be deemed to be in default under this Agreement for such period of fifteen (15) Trading Days after the end of a fiscal quarter during which the Company cures such default or obtains a waiver of such default.
No Violation of Covenants. Tenant covenants and agrees not to commit, suffer or permit any violation of any covenant, condition or restriction affecting the Demised Premises or the Property. Landlord will not hereafter enter into any covenant or restriction applicable to Tenant, the Building or the Project that interferes with Tenant’s use of the Demised Premises for the Permitted Use.
No Violation of Covenants. Tenant covenants and agrees not to commit, suffer or permit any violation of any covenants, conditions or restrictions affecting the Premises or the Property, SO LONG AS TENANT HAS BEEN NOTIFIED IN WRITING OF SUCH COVENANTS AND HAS BEEN PROVIDED A COPY OF SAME.
No Violation of Covenants. Tenant covenants and agrees not to knowingly or intentionally commit, suffer or permit any violation of any covenants, conditions or restrictions affecting the Premises or the Property, which are recorded with the Wake County Registry, and listed on Exhibit D-2 attached hereto.
