Common use of Non-Applicability of Grievance Procedure Clause in Contracts

Non-Applicability of Grievance Procedure. This grievance procedure cannot be used by the Union or any bargaining unit member to dispute a decision by the College that involves the exercise of judgment including but not limited to decisions not to renew the contract of an employee on annual contract or to dispute a decision by the College not to award a contract, or a promotion, to a unit employee, except to the extent that a grievance alleges the failure by the Administration to follow the procedures set forth in this Agreement.

Non-Applicability of Grievance Procedure. This grievance procedure cannot be used by the Union or any bargaining unit member to dispute a decision by the College CFK that involves the reasonable exercise of judgment including but not limited to decisions not to renew the contract of an employee on annual contract or non-continuing 10-month contract to dispute a decision by the College CFK not to award a contract, or a promotion, to a unit employee, except to the extent that a grievance alleges the failure by the Administration to follow the procedures set forth in this Agreement.

Non-Applicability of Grievance Procedure. This grievance procedure cannot be used by the Union UFMDCC or any bargaining unit member employee to dispute a decision by the College that involves the exercise of judgment including but not limited to decisions not to renew the contract of an employee on annual contract contract, or to dispute a decision by the College not to award a continuing contract, or a promotion, or an Endowed Chair to a unit employee, except to the extent that a grievance alleges the failure by the Administration to follow the procedures set forth in this Agreement.
