Non-availability of Service. The good functioning of the Digital Telephony 9-1-1 service is reliant on the good functioning of the computer (including associated software components) on which the Softphone is installed, as well as on the bandwidth and quality of the broadband Internet service to which the computer is connected. Digital Telephony 9- 1-1 service will not function if there is a power or broadband Internet service outage, if the Softphone is not functioning, if the Softphone is not properly logged-in, or if the Digital Telephony service or broadband Internet service is suspended or disconnected. Digital Telephony 9-1-1 emergency services are not available outside of Canada, or in regions where these services are not provided.

Non-availability of Service. The Supplier does not guarantee that the Services will be provided to the Customer at any particular time or continuously. The Supplier reserves the right to suspend the Services at any time for any operational reasons whatsoever. The Supplier does not accept any liability for: Non-Availability of Service caused by routine maintenance or other operational reasons. The Supplier will use reasonable efforts to ensure that any routine maintenance is conducted with as little disruption as possible to the Customer. Non-Availability of Service caused by the failure of any third party; Data which is incorrectly backed up or when backed up cannot be successfully restored. In the event of any Non-Availability of Service, the Supplier will use reasonable endeavours to restore the Services as quickly as possible. The Customer undertakes to obtain suitable insurance against any losses caused by Non-Availability of Service at its own expense.

  • Availability of Services CBT agrees not to discontinue or refuse to provide any service provided or required hereunder other than in accordance with the terms of this Agreement, or unless required by the Commission.

  • Non-Availability of Funds Every obligation of the State under this Agreement is conditioned upon the availability of funds appropriated or allocated for the fulfillment of such obligations. If funds are not allocated and available for the continuance of this Agreement, this Agreement may be terminated by the State at the end of the period for which the funds are available. No liability shall accrue to the State in the event this provision is exercised, and the State shall not be obligated or liable for any future payments as a result of termination under this paragraph.

  • DNS service availability Refers to the ability of the group of listed-­‐as-­‐authoritative name servers of a particular domain name (e.g., a TLD), to answer DNS queries from DNS probes. For the service to be considered available at a particular moment, at least, two of the delegated name servers registered in the DNS must have successful results from “DNS tests” to each of their public-­‐DNS registered “IP addresses” to which the name server resolves. If 51% or more of the DNS testing probes see the service as unavailable during a given time, the DNS service will be considered unavailable.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.

  • EPP service availability Refers to the ability of the TLD EPP servers as a group, to respond to commands from the Registry accredited Registrars, who already have credentials to the servers. The response shall include appropriate data from the Registry System. An EPP command with “EPP command RTT” 5 times higher than the corresponding SLR will be considered as unanswered. If 51% or more of the EPP testing probes see the EPP service as unavailable during a given time, the EPP service will be considered unavailable.

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.
