Common use of Non-Compliance with this Agreement Clause in Contracts

Non-Compliance with this Agreement. (i) The Borrower shall fail to comply with any of the Borrower's agreements set forth in Section 8.11 or shall fail to deliver financial statements or reports required under Section 7.1, or (ii) The Borrower shall fail to comply with any of the Borrower's agreements set forth in this Agreement (and not constituting an Event of Default under any of the other subsections of this Section 9.1, including, without limitation, Section 9.1(h)(i)), and such failure to comply shall continue for ten (10) days;

Non-Compliance with this Agreement. (i) The Borrower shall fail to comply with any of the Borrower's agreements set forth in SECTION 5.3 , SECTION 5.6, any provision of ARTICLE VI or any provision of Section 8.11 or shall fail to deliver financial statements or reports required under Section 7.1, 7 of SUPPLEMENT A; or (ii) The Borrower shall fail to comply with any of the Borrower's agreements set forth in this Agreement (and not constituting an Event of Default under any of the other subsections of this Section 9.1SECTION 7.1, including, without limitation, Section 9.1(h)(iSECTION 7.1(g)(i)), and such failure to comply shall continue for ten twenty (1020) days;
