Common use of Non-Conforming Measures Clause in Contracts

Non-Conforming Measures. 1. Articles 10.3, 10.4, 10.7, and 10.8 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.3, 10.4, 10.7, and 10.8.

Non-Conforming Measures. 1. Articles 10.39.3, 10.49.4, 10.7, 9.5 and 10.8 9.6 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.39.3, 10.49.4, 10.7, and 10.89.5 or 9.6.

Non-Conforming Measures. 1. Articles 10.3Article 8.4, 10.4Article 8.5, 10.7, Article 8.10 and 10.8 do Article 8.11 shall not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional aregional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) ), to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.3Article 8.4, 10.4Article 8.5, 10.7, and 10.8Article 8.10 or Article 8.11.

Articles 10.2, 10.3, 10.4, 10.7, and 10.8 10.5 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph sub-paragraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph sub-paragraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.2, 10.3, 10.4, 10.7, and 10.8or 10.5.

Non-Conforming Measures. 1. Articles 10.311.2, 10.411.3, 10.711.4, and 10.8 11.5 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I;, (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; , or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.311.2, 10.411.3 , 10.711.4, and 10.8or 11.5.

Non-Conforming Measures. 1. Articles 10.3, 10.4, 10.7, 11.2 through 11.5 and 10.8 11.8 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex IXxxxx XXX; (ii) a regional level of government, as set out by that Party in its Schedule to Annex IXxxxx XXX; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.311.2, 10.411.3, 10.711.4, and 10.8or 11.8. (3) 2. Annex 11-B sets out certain specific commitments by each Party.

Non-Conforming Measures. 1. Articles 10.3, 10.4, 10.7, 12.2 through 12.5 and 10.8 12.8 and Section A of Annex 12.9 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I;Xxxxx XXX, (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; Xxxxx XXX, or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 10.312.2, 10.412.3, 10.712.4, and 10.812.8 and Section A of Annex 12.9.
