Common use of Non-Discretionary Clause in Contracts

If the School begins utilizing any additional non-discretionary waivers at any point during the Term, a written notification must be provided to the COMMISSION within 30 days of first use of the waiver, and the Contract may be amended to reflect the use of such non-discretionary waiver.
