Non-Exclusive Relationships with ROW Consultants. 17 Many qualified consultants with ROW acquisition and relocation service experience are 18 or have been under contract with ADOT to assist ADOT with ROW acquisition and 19 relocation services for the Project. ADOT has granted such ROW consulting firms 20 organizational conflict of interest waivers to allow such firms to team with Proposers. 21 Such waivers are subject to two terms and conditions affecting Proposers:

  • Non-Exclusive Relationship The relationship between the parties is a non-exclusive one, which allows the Contractor and the Principal to engage in other activities, provided that all of the terms and conditions under this Agreement are strictly observed, including the avoidance of conflicts of interests. Notwithstanding the foregoing:

Business Associate must enter into this Business Associate Agreement before any use by or disclosure of PHI to such agent. The written agreement must identify Covered Entity as a direct and intended third party beneficiary with the right to enforce any breach of the agreement concerning the use or disclosure of PHI. Business Associate shall provide a copy of the Business Associate Agreement it enters into with a subcontractor to Covered Entity upon request. Business associate may not make any disclosure of PHI to any Subcontractor without prior written consent of Covered Entity.

  • Relationship Between Parties Each party will be deemed to represent to the other party on the date on which it enters into a Transaction that (absent a written agreement between the parties that expressly imposes affirmative obligations to the contrary for that Transaction):
