Common use of Non-Political Event Clause in Contracts

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. Non-Political Event. Non-Political Event. 23.2.1 A Non-Political Event shall mean one or more of the following acts or events: (a) act Acts of God, epidemic, extremely adverse weather conditions, lightninglightening, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or chemical, radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or Permits (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (ec) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or; d) strikes or boycotts (fother than those involving the Concessionaire, Contractors or their respective employees / representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Site for a continuous period of 24 (twenty four) hours and an aggregate period exceeding 7 (seven) days in an Accounting Year, and not being an Indirect Political Event, as set forth in Article 23.3. e) any other event or circumstances circumstance of a nature analogous to any of the foregoing.

Non-Political Event. Non-Political Event. Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.334.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Concessioning Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.327.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorOperator, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3Article 22.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Operator in any proceedings for reasons other than (iI) failure of the Contractor Operator to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (d) Closure and / or suspension of all major operations (as certified and recommended by the Independent Consultant) at the Xxxxxxxxxx Xxxxx Port (e) the The discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any Any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- Sub-contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Railway Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.322.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in Concessionairein any proceedings for reasons other than (i) failure of the Contractor to Concessionaireto comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; or (v) breach of its obligations by the Concessionaire under its Sub- contracts; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site Site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing, radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors, or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway SLF for a continuous period of 24 72 (twenty-fourseventy two) hours and an aggregate period exceeding 10 14 (tenfourteen) days in an Accounting Yearyear, and not being an Indirect Political Event set forth in Clause 21.3Article 8.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political Event;Event and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor. (d) any judgement judgment or order of any court of court, competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, Permit or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityGovernment; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site Site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Sitesite of the Institute); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to and/or the Project Highway construction, operation and maintenance of the LED Facade for a continuous period of 24 (twenty-twenty four) hours and an aggregate period period, exceeding 10 30 (tenthirty) days in an Accounting Yeara financial year, and not being an Indirect Political Event set forth in Clause 21.318.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityADA; (ed) the discovery of geological conditions, toxic contamination or archaeological remains on the Site premises of the MLCP building that could not reasonably have been expected to be discovered through a site inspection; or (fe) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the SiteService Area); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 7 (twenty-fourseven) hours and an aggregate period exceeding 10 (ten) days in an Accounting Yeardays, and not being an Indirect Political Event set forth in Clause 21.3Article 26.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority;; or (e) the discovery of geological conditions, toxic contamination or archaeological remains on in any part of the Site Service Area that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.;

An Indirect Political Event shall mean one or more of the following acts or event; an act of war (fwhether declared or undeclared), invasion, armed conflict or act of foreign enemy, blockade, embargo, riot, insurrection, terrorist or military action, civil commotion or politically motivated sabotage; industry-wide or State-wide strikes or industrial action for a continuous period of 24 (twenty four) hours and exceeding an aggregate period of 7 (seven) days in an Accounting Year; any civil commotion, boycott or political agitation which prevents collection of Fee by the Concessionaire for an aggregate period exceeding 7 (seven) days in an Accounting Year; any failure or delay of a Contractor to the extent caused by any Indirect Political Event and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; any Indirect Political Event that causes a Non-Political Event; or any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; orhave (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractorcontractors, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 7 (twenty-fourseven) hours days and an aggregate period exceeding 10 14 (tenfourteen) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.326.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to Concessionaire, by, or on behalf of such Contractor; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- Sub-contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.319.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityAuthority;or (v) breach of its obligations by the Contractor under its sub-contracts; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorDeveloper, Sub- contractors Sub-Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.326.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Developer by or on behalf of such Sub-Contractor; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Developer in any proceedings for reasons other than (i) failure of the Contractor Developer to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthoritySH&DB; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. ‌ A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.326.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) Radioactive contamination or ionising radiation; c) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway Diagnostic centres for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.322.3; (cd) any failure or delay of a Sub-contractor Contractor including O&M Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Sub-Contractor; (de) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (ef) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (fg) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.327.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.329.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- Sub-contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the SitePremise); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.329.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site Premises that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) a. act of God, ,epidemic, extremely adverse weather conditions, adverseweatherconditions,lightning, ,earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) b. strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty24(twenty-four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, Year and not being an Indirect Political Event set forth in Clause 21.3Article27.3; (c) c. any failure or delay of a Sub-contractor Subcontractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Subcontractor; (d) d. any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, ; or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, ; or (iii) enforcement of this Agreement, ; or (iv) exercise of any of its rights under this Agreement by the Authority; (e) e. the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) f. any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Project Site); (b) strikes or boycotts (other than those involving the ContractorDeveloper, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway Facilities for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.318.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Developer by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Developer in any proceedings for reasons other than (i) failure of the Contractor Developer to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityNRDA; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Project Site that could not reasonably have been expected to be discovered through a site Project Site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 7 (twenty-fourseven) hours and an aggregate period exceeding 10 (ten) days in an Accounting Yeardays, and not being an Indirect Political Event set forth in Clause 21.334.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityGOTN, HD; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors Subcontractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Lawor Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. ‌ A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.327.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 30 (tenthirty) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.have

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway PROJECT for a continuous period of 24 (twenty-twenty- four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority Authority/GMDA made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 7 (twenty-fourseven) hours days and an aggregate period exceeding 10 60 (tensixty) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (ed) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (fe) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. 10.2.1 A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway development/implementation for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and Year not being an Indirect Political Event set forth in Clause 21.3Article 10.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/employees/ representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.334.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or or (iii) enforcement of this Agreement, or or (iv) exercise of any of its rights under this Agreement by the AuthorityGovernment; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising ionizing radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.328.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Non- Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the The discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any Any event or circumstances of a nature analogous to any of the foregoing.

A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway development/implementation for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and Year not being an Indirect Political Event set forth in Clause 21.3Article 11.3; (c) any failure or delay of a Sub-contractor Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityAMC; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.319.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityAuthority;or (v) breach of its obligations by the Contractor under its sub-contracts; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. 23.2.1 A Non-Political Event shall mean one or more of the following acts or events: (a) act a. Acts of God, epidemic, extremely adverse weather conditions, lightninglightening, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or chemical, radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political Event; (d) b. any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or Permits (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (e) c. the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or; d. strikes or boycotts (fother than those involving the Concessionaire, Contractors or their respective employees / representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Site for a continuous period of 24 (twenty four) hours and an aggregate period exceeding 7 (seven) days in an Accounting Year, and not being an Indirect Political Event, as set forth in Article 23.3. e. any other event or circumstances circumstance of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (ai) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (bii) strikes or boycotts (other than those involving the Contractor, Sub- contractors Service Provider or their its respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway Services for a continuous period of 24 exceeding 7 (twenty-four) hours and an aggregate period exceeding 10 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.3Event; (ciii) any failure or delay on the part of a Sub-contractor an agent of the Service Provider but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Service Provider by or on behalf of such agent of the Service Provider; (div) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Service Provider in any proceedings for reasons other than (i) failure of the Contractor Service Provider to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this AgreementContract, or (iv) exercise of any of its rights under this Agreement Contract by the Authority; (ev) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (fvi) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Project Site); (b) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway Facilities for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.314.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Contractor; (d) any judgement or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityDUSIB; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Project Site that could not reasonably have been expected to be discovered through a site Project Site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) strikes or boycotts (other than those involving the Contractor, Sub- Sub-contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Railway Project Highway for a continuous period of 24 (twenty-four) hours and an aggregate period exceeding 10 (ten) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.319.3; (c) any failure or delay of a Sub-contractor but only to the extent caused by another Non-Non- Political Event; (d) any judgement or order of any court of competent jurisdiction or statutory authority SPV made against the Contractor in any proceedings for reasons other than (i) failure of the Contractor to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the AuthorityAuthority;or (v) breach of its obligations by the Contractor under its sub-contracts; (e) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (f) any event or circumstances of a nature analogous to any of the foregoing.

Non-Political Event. A Non-Political Event shall mean one or more of the following acts or events: (a) act of God, epidemic, extremely adverse weather conditions, lightning, earthquake, landslide, cyclone, flood, volcanic eruption, chemical or radioactive contamination or ionising radiation, fire or explosion (to the extent of contamination or radiation or fire or explosion originating from a source external to the Site); (b) Radioactive contamination or ionising radiation; c) strikes or boycotts (other than those involving the ContractorConcessionaire, Sub- contractors Contractors or their respective employees/representatives, or attributable to any act or omission of any of them) interrupting supplies and services to the Project Highway Diagnostic Centres for a continuous period of 24 (twenty-twenty four) hours and an aggregate period exceeding 10 7 (tenseven) days in an Accounting Year, and not being an Indirect Political Event set forth in Clause 21.322.3; (cd) any failure or delay of a Sub-contractor Contractor including O&M Contractor but only to the extent caused by another Non-Political EventEvent and which does not result in any offsetting compensation being payable to the Concessionaire by or on behalf of such Sub-Contractor; (de) any judgement judgment or order of any court of competent jurisdiction or statutory authority made against the Contractor Concessionaire in any proceedings for reasons other than (i) failure of the Contractor Concessionaire to comply with any Applicable Law or Applicable Permit, or (ii) on account of breach of any Applicable Law or Applicable Permit or of any contract, or (iii) enforcement of this Agreement, or (iv) exercise of any of its rights under this Agreement by the Authority; (ef) the discovery of geological conditions, toxic contamination or archaeological remains on the Site that could not reasonably have been expected to be discovered through a site inspection; or (fg) any event or circumstances of a nature analogous to any of the foregoing.
