Common use of Non-Profit Organization Clause in Contracts

Non-Profit Organization. As stated in the School’s Application (Appendix 1) and as required by Section 1002.33(12)(i), Florida Statutes, the School has been organized as a Florida non-profit organization and shall maintain status as a Section 501(c)3 status under the Internal Revenue Code. Voting shall control the non-profit organization, and only the School’s Governing Board shall vote. The School shall at all times operate as a non-profit corporation and shall annually provide proof to the Sponsor of the School’s status as a non-profit organization. Such status shall not be permitted to lapse, be revoked or terminate. Failure to comply with this section within 30 calendar days of written notice of a violation will constitue a material violation of the Charter and be good cause for its termination by the Sponsor.
