Non-Waiver; Cumulative Remedies. No failure on the part of Lender to exercise and no delay in exercising any right hereunder shall operate as a waiver thereof, nor shall any single or partial exercise by Lender of any right hereunder preclude any other or further right of exercise thereof. The remedies herein provided are cumulative and not alternative.

The rights, remedies, powers, and privileges herein provided are cumulative and not exclusive of any rights, remedies, powers, and privileges provided by law.

A Party’s failure to exercise or delay in exercising a right or remedy under this Agreement does not constitute a waiver of the right or remedy or a waiver of other rights or remedies unless the Parties expressly agree in writing. The rights and remedies provided in this Agreement are cumulative and are in addition to all rights and remedies which the Investor or the Company may have in law or in equity or by statute or otherwise.
Non-Waiver; Cumulative Remedies. Either party’s acceptance of monies under this Lease following a Default by the other shall not waive such party’s rights regarding such Default. No waiver by either party of any violation or breach of any of the terms contained herein shall waive that party’s rights regarding any future violation of such term. Landlord’s acceptance of any partial payment of Rent shall not waive Landlord’s rights with regard to the remaining portion of the Rent that is due, regardless of any endorsement or other statement on any instrument delivered in payment of Rent or any writing delivered in connection therewith; accordingly, Landlord’s acceptance of a partial payment of Rent shall not constitute an accord and satisfaction of the full amount of the Rent that is due. Any and all remedies set forth in this Lease: (1) shall be in addition to any and all other remedies either party may have at law or in equity; (2) shall be cumulative; and (3) may be pursued successively or concurrently as such party may elect. The exercise of any remedy by either party shall not be deemed an election of remedies or preclude that party from exercising any other remedies in the future, except as expressly set forth herein.

The failure of Buyer to insist upon strict performance of any terms and conditions hereof, failure or delay to exercise any rights or remedies provided herein or by law, failure to properly notify Seller in the event of breach, the acceptance of or payment for any Goods, or approval of design, shall not release Seller from any of the warranties or obligations and shall not be deemed a waiver of any right of Buyer to insist upon strict performance or of any of its rights or remedies as to the Goods or as to any prior or subsequent default, nor shall any purported oral modification or rescission of the Order by Buyer operate as a waiver of any of the terms hereof. Any right or remedy of Xxxxx provided herein is in addition to Xxxxx's other rights and remedies provided herein or by law. COMPLIANCE WITH LAWS Seller warrants and agrees that it shall comply with all applicable laws, regulations and administrative requirements and not take any action that would subject Buyer penalties under U.K.. or foreign laws, regulations or administrative requirements.
Non-Waiver; Cumulative Remedies. No failure or delay by any party to exercise or to insist upon the performance, in whole or in part, of any term, condition, covenant, right, legal or equitable remedy or any provision of this Agreement, shall constitute a waiver of any such term, condition, covenant, right, legal or equitable remedy or provision, or preclude such party from exercising or insisting upon the performance, in whole or in part, of any such term, condition, covenant, right, legal or equitable remedy or provision of this Agreement at any later time. No waiver of the applicability of any provision of this Agreement shall be deemed implied from the execution by the Sole Underwriter, and the Issuer of this Agreement. All remedies, rights and options under this Agreement or otherwise afforded a party shall be cumulative and not alternative, and shall be in addition to and not in substitution for or in derogation of the rights and remedies conferred by law. Unless otherwise required under this Agreement, no notice to or demand on a party in any case shall entitle it to any other or further notice or demand in similar or other circumstances.

The failure on the part of either party to this Sublease to act upon a breach of any of the covenants or agreements contained herein shall in no way constitute a waiver of the rights of such party to act upon any other or future breach by the other party. Any and all rights and remedies created for either party herein shall be deemed cumulative and the use of one remedy shall not be taken to exclude the right to use any other.

No course of dealing or any delay or failure to exercise any right hereunder on the part of any Warrantholder or any holders of Warrant Shares shall operate as a waiver of such right or otherwise prejudice the rights, powers or remedies of such Warrantholder or such holders of Warrant Shares. The rights and remedies provided in this Warrant are cumulative and are in addition to all rights and remedies which each Warrantholder and each holder of Warrant Shares may have in law or in equity or by statute or otherwise.
Non-Waiver; Cumulative Remedies. Any delay or failure on the part of either of the parties to this Agreement to insist upon performance of any of the provisions of this Agreement or to pursue any of their respective rights or remedies hereunder shall not be construed as a waiver of any such provision or the relinquishment of any such rights or remedies. The parties' rights and remedies provided hereunder are cumulative and may be exercised singly or concurrently, and are not exclusive of any rights and remedies provided by law. In the event of any litigation with regard to this Agreement, the prevailing party or parties shall be entitled to receive from the non-prevailing party or parties, and the non-prevailing party or parties immediately shall pay, all reasonable attorneys' fees, court costs and related expenses incurred by the prevailing party or parties.
