Common use of Noncompetition/Nonsolicitation Period Clause in Contracts

Noncompetition/Nonsolicitation Period. The provisions of Paragraph shall continue, beyond the time periods set forth in such paragraph, to apply with respect to Employee for the shorter of (x) twelve months following the date of termination or (y) until such time as the Company has failed to comply with the provisions of Paragraph for a an uninterrupted 10-day period and such failure is not cured within 5 days after written notice of such failure is delivered to at least two directors of the Company (other than Employee).

Noncompetition/Nonsolicitation Period. The provisions of Paragraph 14 shall continue, beyond the time periods set forth in such paragraph, to apply with respect to Employee for the shorter of (x) twelve months following the date of termination or (y) until such time as the Company has failed to comply with the provisions of Paragraph 7.b.i for a an uninterrupted 10-day period and such failure is not cured within 5 days after written notice of such failure is delivered to at least two directors of the Company (other than Employee).

Noncompetition/Nonsolicitation Period. The provisions of Paragraph 12 shall continue, beyond the time periods set forth in such paragraph, to apply with respect to Employee for the shorter of (x) twelve months following the date of termination or (y) until such time as the Company has failed to comply with the provisions of Paragraph 6.b.i for a an uninterrupted 10-day period and such failure is not cured within 5 days after written notice of such failure is delivered to at least two directors of the Company (other than Employee).

Noncompetition/Nonsolicitation Period. The provisions of Paragraph Paragraphs 12 and 13 shall continue, beyond the time periods set forth in such paragraphparagraphs, to apply with respect to Employee for the shorter six months. The noncompetition and nonsolicitation provisions of (x) twelve months following the date of termination or (y) until such time as this Agreement shall no longer apply to Employee if the Company has failed fails to comply with pay the amounts required under the provisions of Paragraph 7b(i) for a an uninterrupted 10-day period and such failure is not cured within 5 10 days after written notice of such failure is delivered to at least two directors of the Company (other than Employee)Company.

The provisions of Paragraph 13 and 14 shall continue, beyond the time periods set forth in such paragraphparagraphs, to apply with respect to Employee employee for the shorter of (x) twelve twenty-four (24) months following the date of termination or (y) until such time as the Company has failed to comply with the provisions of Paragraph subparagraph 7.b.i for a an uninterrupted 10-day period and such failure is not cured within 5 15 days after written notice of such failure is delivered to at least two non-employee directors of the Company (other than Employee)Company.
