Common use of Nonrefundable Xxxxxxx Money Clause in Contracts

Nonrefundable Xxxxxxx Money. The xxxxxxx monies paid by Buyer on this Contract are nonrefundable, except if title cannot be made marketable in accordance with the terms of this Contract and closing does not occur due to the failure of unmarketable title or other reasons attributed to Seller. In the event title cannot be made marketable and closing does not occur due to the failure of unmarketable title or other reasons attributed to Seller, then the xxxxxxx money shall be automatically refunded to Buyer without further action or approval by Seller required.
