Common use of NOTICE AND ADMINISTRATION OF SETTLEMENT Clause in Contracts

NOTICE AND ADMINISTRATION OF SETTLEMENT. 55. No later than sixty (60) days after the Preliminary Approval of this Settlement, the Claims Administrator shall have sent a copy of the Individual Notice and a Claim Form (or Claim Forms if a Class Member has multiple claims), pre-printed with the Class Member’s name and most recent address as determined below in this Paragraph and Paragraphs 54 and 56, the date of the loss, and the vehicle make, model, and year, by first-class mail, to each Person on the Updated Settlement Class List. Prior to any mailing the Claims Administrator shall update all addresses on the Class List by running the addresses thereon through the National Change of Address Data Base and “True Trace”. Defendants and the Claims Administrator shall use their best efforts to complete the mailing of the Individual Notice and Claim Form to each Person on the Updated Settlement Class List, as soon as possible, but no later than sixty (60) days after the Preliminary Approval of the Settlement as provided herein. The Individual Notice will be approved as to form and content by the Court and be in the form attached hereto as Exhibit “C” unless otherwise modified by agreement of the Parties and approved by the Court. The mailing to the Settlement Class Members that contains the Individual Notice will also include a copy of the Claim Form, attached hereto as Exhibit “A.”

The Individual Notice will be approved as to form and content by the Court and be in the form attached hereto as Exhibit “C” C unless otherwise modified by agreement of the Parties and approved by the Court. The mailing to the Settlement Class Members that contains the Individual Notice will also include a copy of the Claim Form, attached hereto as Exhibit “A.”

The Individual Notice will be approved as to form and content by the Court and be in the form attached hereto as Exhibit “CB” unless otherwise modified by agreement of the Parties and approved by the Court. The mailing to the Settlement Class Members that contains the Individual Notice will also include a copy of the Claim Form, attached hereto as Exhibit “A.”

No later than sixty (60) days after the Preliminary Approval of this Settlement, the 2 Claims Administrator shall have sent send a copy of the Individual Notice and a Claim Form (or Claim 3 Forms if a Class Member has multiple claimsqualifying total losses), pre-printed populated with the Class 4 Member’s name and most recent address as determined below in this Paragraph and Paragraphs 54 and 56address, the date of the loss, and the vehicle make, model, make and year, by 5 by first-class mail, mail to each Person on Class Member, using the Updated Settlement Class Listmost recent addresses provided by Progressive 6 from its records. Prior to mailing any mailing Individual Notices or Claim Forms, the Claims Administrator 7 shall update all the relevant Class Members’ addresses on the Settlement Class List by running the 8 addresses thereon through the National Change of Address Data Base and “True Trace”Database. Defendants Defendant and the Claims 9 Administrator shall use their best efforts to complete the mailing of the Individual Notice and 10 Claim Form to each Person Class Member on the Updated Settlement Class List, List as soon as possible, but no later 11 than sixty (60) days after the Preliminary Approval of the Settlement as provided hereinSettlement.
