Notice of Completion and Lien Releases. Upon completion of the construction of an Improvement, Owner shall notify the City Engineer in writing of such completion and shall prepare and execute a Notice of Completion for such Improvement in the form prescribed by Section 3093 of the California Civil Code and shall record such notice in the Official Records of the County of San Diego. Owner shall cause its contractors to provide unconditional lien releases for such Improvement in accordance with Section 3262 of the Civil Code. Notwithstanding the foregoing, City may waive the requirement for a Notice of Completion and lien releases if City determines that as of the date of payment of the Retained Increment of the Purchase Price for an Improvement, title to such Improvement or portion thereof satisfies the requirements for Acceptable Title (as hereinafter defined).
Notice of Completion and Lien Releases. The Company shall notify the Director, in writing, upon completion of each Project Facility, Privately-Owned Dry Utility and the Drainage Basin Facility to be acquired hereunder by the County and/or financed by the District. The Company shall prepare and execute a Notice of Completion in form acceptable to the Director as to such work and record such notice in the office of the Clerk-Recorder of the County of Orange, State of California, and cause its contractor(s) to provide lien releases in a form acceptable to the Director for all such work.

Notwithstanding the foregoing, the Director may waive the requirement for a Notice of Completion and lien releases if the Director determines that, as of the date of payment of the Purchase Price for a Project Facility, title to such Project Facility meets the requirements for “Acceptable Title” as defined in Section 4(h)(1) below.
