Notice of Environmental Damage. The Borrower will, promptly upon acquiring knowledge thereof, notify the Agent of the discovery of any Contaminant or of any Release of a Contaminant into the Environment from or upon the land or property owned, operated or controlled by any of the Harvest Parties which would reasonably be expected to have a Material Adverse Effect.

The Borrower will promptly, and in any event within 5 Banking Days, upon becoming aware thereof, notify the Agent of the discovery of any Contaminant or of any Release of a Contaminant into the Environment from or upon the land or property owned, operated or controlled by any of the Enerplus Parties which would reasonably be expected to have a Material Adverse Effect.

The Borrower shall promptly provide the Agent with written notice of the discovery of any Release of Hazardous Materials into the environment from or upon the land or property of any Borrower Group Member, which Release would reasonably be expected to result in liability of the Borrower Group exceeding Cdn. $1,000,000 in aggregate in any Fiscal Year.
Notice of Environmental Damage the Borrower and Petro-Canada shall, promptly upon acquiring actual knowledge thereof, provide the Agent with written notice of the discovery of any Release from or upon the land or property of the Borrower or Petro-Canada or a Subsidiary which is contrary to applicable Environmental Laws and which has had or would reasonably be expected to have a Material Adverse Effect;

The Borrower will immediately notify the Administrative Agent in the event of a breach of any material provision of Environmental Laws including without limitation, if a material contaminant spill or emission occurs or is discovered with respect to the Borrower's or any Subsidiary's property, operations, or those of any neighbouring property. In addition, it will report to the Administrative Agent forthwith any material Environmental Claim or fine that the Borrower or any Restricted Subsidiary may receive or be ordered to pay with respect to such Environmental Claims relating to its business or property. The Borrower will, forthwith upon acquiring knowledge thereof, notify the Agent of the discovery of any breach, potential breach, fact, circumstance or condition that is likely to result in any Environmental Liabilities or investigation, claim, order, suit, action or proceedings regarding the breach of any Environmental Laws or the provisions of any Environmental Permits including, without limitation, any knowledge or discovery of any Releases of a Hazardous Material from or upon the land or property owned (either individually or jointly), operated or controlled by any Consolidated Party, which could result in aggregate liabilities in excess of $100,000.
