Common use of Notice of Facility Change Clause in Contracts

Notice of Facility Change. The Authority will notify Project Co of any Facility Change which the Authority intends to make pursuant to the exercise of the Authority’s rights under Section 11.1(d) or Section 11.2 and provide Project Co a reasonable opportunity, taking into account all the circumstances, to comment on the proposed Facility Change. In making such Facility Change, the Authority will reasonably consider comments received in a timely manner from Project Co on the proposed Facility Change.
