Notices sent. 1. by hand will be effective upon delivery;
Notices sent. 12.2.1 by hand will be effective upon delivery;
Notices sent. (a) by hand are taken to be received when delivered;
(b) by post to an address in Australia are taken to be received by the third Business Day after posting;
(c) by post to an address outside Australia are taken to be received by the seventh Business Day after posting; or
(d) by fax are taken to be received when the sender’s fax machine issues a successful transmission report.
Notices sent. 19.2.1. by email are taken to be received when the email is capable of being retrieved by the addressee at its nominated email address;
19.2.2. by hand are taken to be received when delivered; and
19.2.3. by post are taken to be received three Business Days after posting (or seven Business Days after posting if sent to or from a place outside Australia).
Notices sent. (a) by hand are deemed to be received when delivered;
(b) by post to an address in the UK are deemed to be received by the third Business Day after posting;
(c) by post to an address outside the UK are deemed to be received by the fifth Business Day after posting;
(d) by fax are deemed to be received at the time of transmission or if not on a Business Day then at 9am on the next Business Day;
(e) by email are deemed to be received one hour after transmission if on a Business Day if not then at 9am on the next Business Day.
Notices sent. (i) via the relevant Order System (or other Tandem system capable of delivering a notice to the Subcontractor) are taken to be received when the system records that the notification has been accessed by the Subcontractor;
(ii) by hand are taken to be received when delivered;
(iii) by post to an address in Australia are taken to be received by the seventh Business Day after posting; or
(iv) by email, are taken to be received 2 hours after the time sent (as recorded on the device from which the sender sent the email), unless the sender receives an automated message that the email has not been delivered.
Notices sent. (a) by prepaid mail will be taken to be received on the third Business Day after posting; and
(b) by facsimile will be taken to be received on production of a transmission report from the transmitting machine indicating a successful transmission of the facsimile; and
(c) by email will be taken to be received when the email enters the recipient’s mail server.
