Common use of NOTIFICATION OF CONTRACTOR Clause in Contracts

NOTIFICATION OF CONTRACTOR. Any act or omission of Contractor which Subcontractor might claim as an excuse for his own failure to perform shall be deemed waived by Subcontractor unless he shall notify Contractor of his intention to assert such excuse within ten days after the occurrence of any such act or omission. Subcontractor waives any right it might have to assert the provisions of California Civil Code Section 1654 against Contractor.
