Common use of Notification of High Traffic Clause in Contracts

Notification of High Traffic. The Merchant is obliged to notify Strex in writing at least five (5) business days in advance in the event that the Merchant is expecting higher traffic on Strex’ systems than the maximum allowed level of traffic measured in number of messaging transactions per second as specified the Product Description. Strex will in such events send the Merchant a reply within three (3) business days from receipt of such notice, informing whether or not the Messaging Service can be expected to handle the expected traffic level. If the reply from Strex is that the Messaging Service cannot be expected to handle the expected traffic level, or if there is no reply, the Merchant is obliged to unable the use of the Messaging Service for the particular event in the particular time window where the relevant traffic peak is expected. Strex reserves the right to block the Messaging Service with immediate effect in the event of lack of prior written notification of higher traffic than allowed according to the Product Description or as otherwise agreed.

Strex reserves the right to block the Messaging Strex Connect Service with immediate effect in the event of lack of prior written notification of higher traffic than allowed according to the Product Service Description or as otherwise agreed.
