NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall notify by facsimile each of the other Paying Agents forthwith:
(a) if it has not by the relevant date specified in subclause 5.1 received unconditionally the full amount in euro required for the payment; and
(b) if it receives unconditionally the full amount of any sum due in respect of the Notes or Coupons after such date. The Fiscal Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in subparagraph (b), cause notice of that receipt to be published under Condition 11.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. 5.1 The Paying Agent shall, as soon as reasonably practicable, notify the applicable Trustee and, if Definitive Registered Senior Notes or Definitive Registered Junior Notes have been issued, the Registrar if:
(a) either (i) the Paying Agent has not by the relevant date and time specified in Clause 4.1 received unconditionally the full amount required for the payment specified in Clause 4.1 or (ii) the Paying Agent has not by the relevant date and time specified in Clause 4.2 received a copy of the irrevocable payment instruction referred to in Clause 4.2; and
(b) the Paying Agent receives unconditionally the full amount of any sum payable in respect of the Senior Notes or Junior Notes, as the case may be, after that date.
5.2 If the Paying Agent receives an instruction from the Issuer or any Guarantor, as the case may be, to do so, the Paying Agent shall, at the expense of the Issuer or such Guarantor, as the case may be, as soon as reasonably practicable, upon receipt of any amount as described in Clause 5.1(b), cause notice of that receipt to be published in accordance with the instruction under the applicable Indenture.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Principal Paying Agent shall notify by facsimile each of the other Paying Agents (if any) and the Trustee forthwith:
(a) if it has not by the relevant date specified in sub-clause 4.1 received unconditionally the full amount in euro required for the payment; and
(b) if it receives unconditionally the full amount of any sum due in respect of the Securities or Coupons after such date. The Principal Paying Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in sub-clause 5(b), cause notice of that receipt to be published in accordance with Condition 12 (Notices).
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall notify the other Paying Agents and the Issuer forthwith: if it has not by the relevant time on the date specified received unconditionally the amount referred to in Clause 5; and if it receives unconditionally the full amount of any sum due in respect of the Notes after such time. The Fiscal Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in Clause 6.1(b), cause notice of that receipt to be given to Noteholders in accordance with Condition 15.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. If the Principal Paying Agent has not on the due date of any payment to it under Clause 4.1, received either the relevant payment or the relevant irrevocable payment instruction pursuant to Clause 4.2, it shall as soon as reasonably practicable notify each of the Issuer, the Trustee and the other Paying Agents. If the Principal Paying Agent subsequently receives such payment, it shall forthwith notify the Issuer and the other Paying Agents.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall as soon as reasonably practicable notify each of the other Agents and the Issuer:
(a) if it has not received the amount referred to in Clause 5.1 by the time specified for its receipt, unless it is satisfied that it will receive such amount; and
(b) if at any time following the giving of a notice by the Fiscal Agent under Clause 6(a) any payment provided for in Clause 5 is made on or after its due date but otherwise in accordance with this Agreement or the Fiscal Agent is satisfied that it will receive such payment.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall notify each of the other Paying Agents, if any, forthwith:
(a) if it has not by the relevant date specified in subclause 4.1 received unconditionally the full amount in U.S. dollars required for the payment; and
(b) if it receives unconditionally the full amount of any sum due in respect of the Notes or Coupons after such date.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall notify by telex each of the other Paying Agents forthwith:
(a) if it has not by the specified time on the relevant date specified in clause 4.1 received unconditionally the full amount in euro required for the payment; and
(b) if it receives unconditionally the full amount of any sum due in respect of the Notes or Coupons after such date. Upon receipt of a notice from the Fiscal Agent as described in subparagraph (a) and until receipt of a notice from the Fiscal Agent as described in subparagraph (b), no Paying Agent shall be obliged to make any payment in respect of the Notes. The Fiscal Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in subparagraph (b), cause notice of that receipt to be published under Condition 15.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Principal Paying Agent shall notify by facsimile each of the other Paying Agents, the Issuer and the Trustee forthwith:
(a) if it has not by the relevant time specified in Subclause 4.1 received unconditionally the full amount in pounds sterling required for the payment; and
(b) if it receives unconditionally the full amount of any sum due in respect of the Notes or Coupons after such date. The Principal Paying Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in subparagraph (b), cause notice of that receipt to be published under Condition 20.
NOTIFICATION OF NON-PAYMENT BY THE ISSUER. The Fiscal Agent shall notify by email each of the other Paying Agents and the Registrar forthwith:
(a) if it has not by the relevant date specified in Clause 5.1 received unconditionally the full amount in U.S. dollars required for the payment; and
(b) if it receives unconditionally the full amount of any sum payable in respect of the Capital Securities after such date. The Fiscal Agent shall, at the expense of the Issuer, forthwith upon receipt of any amount as described in Clause 6(b), cause notice of that receipt to be published under Condition 15.
