Notification Prior to Incurring Costs. In any circumstances which might give rise to a claim pursuant to this Article, Seller shall, before incurring any cost or expense, first give Buyer every opportunity to determine whether the cost or expense should be incurred or whether any act or forbearance shall or might mitigate the cost of any such claim.
