Notification Requirement as Condition Precedent. In order for the Trust to be liable to exonerate and indemnify a trustee under the terms of this Sec. 5.11 et seq., the trustee must notify the Trust within fourteen (14) days of knowing or having reason to know that a charge or claim has been brought against him, or that a dispute actually exists as evidenced by a writing, or that a cause of action or allegation has been stated in writing. This notification requirement shall not apply to disputes referred to in Article IV of this Agreement.
