Notwithstanding Subsection 16. 8.2, the Company and the FRBNY may make public disclosures of the Manager’s Confidential Information: (x) as referenced elsewhere in this Agreement or (y) otherwise if appropriately requested under any applicable law, governmental or administrative rule, or regulation, provided, however, that with respect to this clause (y) and any disclosure required by law pursuant to clause (v) of Subsection 16.8.2, the FRBNY and/or the Company shall promptly notify the Manager of such request or demand and shall take all steps reasonably required to protect the confidentiality of the Manager’s Confidential Information including, but not limited to, the steps the Manager is required to take to protect Confidential Information of the FRBNY and the Company under Section 16.4.
