Nursery Fees. The Nursery fee rates (Fees) are dependent on your child’s booking patterns and age. We will list our Fees on the Nursery Fee Sheet. The Nursery will not refund any Fees for Nursery closures on public or other Nursery designated closure days. Fees take these closure days into account. Fees are subject to review by NR and we may amend them by providing you with one month’s advance notice. If the Fees are due to change because of your child’s age, the new fee rate will apply from the first of the month following that change. You agree to pay the Fees monthly in advance on the first of each month (Due Date). You may pay your child’s first month’s Fees by cheque, credit or debit card or direct debit. Thereafter, monthly Fees must be paid by direct debit unless the Nursery authorises an alternative payment method in advance. We accept childcare vouchers / Tax Free Childcare (TFC) for all or part payment of the Fees. The Voucher / TFC payment must clear into our account by the Due Date. Otherwise we will automatically apply it to the next month’s Fees and we will consider the current month’s Fees outstanding. If the Fees are paid by a third party on your behalf, e.g. through a salary sacrifice scheme, we may require you and/or the third party to enter into a supplementary agreement. In addition to the Fees, the Nursery reserves the right to charge the following ancillary Nursery fees: late pick-up fee of £20 per half hour; a monthly administration fee of £4.95 if you do not use Direct Debit to pay for Fees; an administration fee of £20 per failed payment; and Additional Care as defined in paragraph six. You agree to pay all such ancillary fees as applicable to you. The Nursery also reserves the right to terminate or suspend your child’s place with immediate effect, if you do not pay the fees by the Due Date or you have any outstanding Nursery fees. The Nursery shall be entitled to charge interest (8% above the Bank of England base rate) on any late Nursery fees. We may also charge for all other associated costs related to non-payment or recovery of any Nursery fees. We will not refund any fees if your child is absent due to illness, holiday, or as required under the Nursery’s policies and procedures. In addition, the Nursery will not refund any Fees or be in breach of this Parent Agreement or otherwise liable to you by reason of any delay in performance or non- performance of its obligations to you due to any event outside its reasonable control. Such events include without limitation ‘acts of God’, fire, war, acts of terrorism, strikes or other industrial action, infectious diseases, epidemic/pandemic requires closure on advice from a health authority to stop cross contamination, Outbreak of illness leading to not enough staff being able to maintain the required staff-child ratio, inclement weather (such as snow or flooding), unforeseeable repairs or any failure of public or utility services, (such as gas leak or power cut leading to lack of light/heat, highway and public transport delays or failures). Mid-month Starts: If your child starts at the Nursery part of the way through a month, you will be sent an invoice which must be paid before the last ‘settling in’ session at the Nursery in readiness for your child’s first full session. Extra Sessions: Extra sessions must be paid for at the time of booking. Any extra sessions cancelled with less than 24 hours’ notice will not refund any Fees or be in breach of this Parent Agreement or otherwise liable refunded. Extra sessions cancelled with more than 24 hours’ notice will be credited to the following months invoice. No monies will be refunded. We do not allow days to be swapped Charges and Payments: Monthly Invoices will be emailed to you around the 20th of each month, showing the exact number of sessions agreed through your payment contract your child attends each month, therefore the amount of your monthly invoice may change from month to month. Payment by reason cash is not accepted. Where the Child is unable to attend but our service remains available full charges will be due. We will charge for bank holidays. VAT is not charged on nursery fees (nursery provision is an exempt supply for VAT purposes). Extra hours (or parts of an hour) will be charged for (at the ruling rate) and must be booked and paid for at least 24 hours in advance. The charges must be paid monthly in advance, by the 1st day of the month. We may increase our charges dependant on the financial climate. We will give you written notice of any delay in performance such increase at least one month before the proposed date of increase. Without restricting any other legal right that we may have, if you fail to pay us on time, we may: Make an interest charge of up to 1.5% per cent per month or non- performance of its obligations part month on late payment. Unless otherwise notified to you in writing, interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us the interest together with the overdue amount. In addition, we will be entitled to recover from you the full amount of our administrative and other costs incurred in recovering any event outside its unpaid sum including legal costs and disbursements on an indemnity basis. and Suspend all services until payment has been made in full, which will include the suspension of the child’s place, or even terminate the contract permanently. If you owe us any money, and make a claim against us, we may offset what you owe us against what you are claiming from us. All payments must normally be made by Faster payment, Tax Free Childcare or childcare vouchers. All payments must be made so that it clears in our bank account by the 1st of the month. Fees are paid in advance not in arrears. If payment is not cleared by the 1st, you will be contacted and if your payment is not cleared by the 5th of the month, you will be charged the current late fee. If any amount is still outstanding on the 14th of the month, we will write to you to confirm non-payment, and your child will be excluded from the Nursery until the account is settled. If you fail to settle your accounts by the 1st of the month on repeated occasions, then we may cancel the child’s place at the Nursery permanently and any deposit held by us will be offset against any outstanding debts, any balance after monies have been deducted will be returned. Free nursery education: If you wish to take up your Government funded nursery education, you are required to complete and sign a Parent/Carer Declaration on a termly basis, detailing how and when you will take up the free sessions. Our charges will not be made in respect of the free sessions as detailed in the Parent/Carer Declaration, but we are entitled to make a reasonable controlcharge for meals or additional activities provided during any free session. Such events include Meals are charged at the current rate as per our fee structure or as part of the extra sessions attended.
