Nursery Fees. The Nursery fee rates (Fees) are dependent on your child’s booking patterns and age. We will list our fees on the nursery Fee Sheet. The nursery will not refund any fees for nursery closures on public holidays or other nursery designated closure days. Fees take these closure days into account. Fees are subject to review by Gymfinity Kids and we may amend them by providing you with one month’s advance notice. If the fees are due to change because of your child’s age, the new fee rate will apply from the first of the month following that change. You agree to pay the fees monthly, in advance on the first of each month (Due Date). You may pay your child’s fees by credit, debit card, or bacs. We may also accept childcare vouchers for all or part payment of the fees. If the nursery accepts the childcare voucher (Voucher), the Voucher payment must clear into our account by the due date. Otherwise, we will automatically apply it to the next month’s fees and we will consider the current month’s fees outstanding. In addition to the fees, the nursery reserves the right to charge the following ancillary nursery fees: late pick-up fee, late payment fees. The nursery also reserves the right to terminate or suspend your child’s place, with immediate effect, if you do not pay the fees by the due date or you have any outstanding nursery fees. The nursery shall be entitled to charge interest on any late nursery fees. We may also charge for all other associated costs related to non-payment or recovery of any nursery fees. We will not refund any fees if your child is absent due to illness, holiday, or as required under the nursery’s policies and procedures. In addition, the nursery will not refund any fees, be in breach of this Parent Agreement, or otherwise be liable to you by reason of any delay in performance or non- performance of its obligations to you due to any event outside its reasonable control. Such events include, without limitation: fire, war, acts of terrorism, strikes or other industrial action, infectious diseases, epidemics, inclement weather (such as snow or flooding), unforeseeable repairs or any failure of public or utility services (such as highway and public transport delays or failures). In the event the nursery applies any discretionary discount to nursery fees, this discount will be solely as a gesture of goodwill and will not constitute any variation of this Parent Agreement.

Mid-month Starts:‌ If your child starts at the Nursery part of the way through a month, you will be sent an invoice which must be paid before the last ‘settling in’ session at the Nursery in readiness for your child’s first full session. Extra Sessions:‌ Extra sessions must be paid for at the time of booking. Any extra sessions cancelled with less than 24 hours’ notice will not refund be refunded. Extra sessions cancelled with more than 24 hours’ notice will be credited to the following months invoice. No monies will be refunded. We do not allow days to be swapped Charges and Payments: Monthly Invoices will be emailed to you around the 20th of each month, showing the exact number of sessions agreed through your payment contract your child attends each month, therefore the amount of your monthly invoice may change from month to month. Payment by cash is not accepted. Where the Child is unable to attend but our service remains available full charges will be due. We will charge for bank holidays. VAT is not charged on nursery fees (nursery provision is an exempt supply for VAT purposes). Extra hours (or parts of an hour) will be charged for (at the ruling rate) and must be booked and paid for at least 24 hours in advance. The charges must be paid monthly in advance, by the 1st day of the month. We may increase our charges dependant on the financial climate. We will give you written notice of any feessuch increase at least one month before the proposed date of increase. Without restricting any other legal right that we may have, if you fail to pay us on time, we may: Make an interest charge of up to 1.5% per cent per month or part month on late payment. Unless otherwise notified to you in writing, interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us the interest together with the overdue amount. In addition, we will be entitled to recover from you the full amount of our administrative and other costs incurred in breach recovering any unpaid sum including legal costs and disbursements on an indemnity basis. and Suspend all services until payment has been made in full, which will include the suspension of this Parent Agreementthe child’s place, or otherwise even terminate the contract permanently. If you owe us any money, and make a claim against us, we may offset what you owe us against what you are claiming from us. All payments must normally be liable made by Faster payment, Tax Free Childcare or childcare vouchers. All payments must be made so that it clears in our bank account by the 1st of the month. Fees are paid in advance not in arrears. If payment is not cleared by the 1st, you will be contacted and if your payment is not cleared by the 5th of the month, you will be charged the current late fee. If any amount is still outstanding on the 14th of the month, we will write to you to confirm non-payment, and your child will be excluded from the Nursery until the account is settled. If you fail to settle your accounts by reason the 1st of the month on repeated occasions, then we may cancel the child’s place at the Nursery permanently and any deposit held by us will be offset against any outstanding debts, any balance after monies have been deducted will be returned. Free nursery education: If you wish to take up your Government funded nursery education, you are required to complete and sign a Parent/Carer Declaration on a termly basis, detailing how and when you will take up the free sessions. Our charges will not be made in respect of the free sessions as detailed in the Parent/Carer Declaration, but we are entitled to make a reasonable charge for meals or additional activities provided during any free session. Meals are charged at the current rate as per our fee structure or as part of the extra sessions attended. Payment by Vouchers:‌ Any parent paying fees with vouchers will be required to pay deposit and registration fee in full, without vouchers. In order to meet the needs of the children who attend the Nursery; we expect parents to support the Nursery and its ethos and in doing so you agree in good faith to: • Work in partnership with all staff. • Inform the Nursery promptly of any delay concerns. • Respond to concerns raised by members of staff. • Support the high standards of behaviour and security in performance the Nursery. • Ensure that one or both parents attend parents’ evenings. • Provide the Nursery with a copy of the child’s 2-year health check. • Ensure that absence from Nursery is reported as soon as possible. • Ensure that children are dropped off by 9:30am so they are able to be a part of the full day’s activities. • Support the Nursery’s inclusion and equal opportunity policies. • Inform the Nursery if you have given your child any non- performance prescribed medicine in the morning before bringing them to the Nursery. • Follow our sickness and time away from the Nursery policy, to prevent illness being spread around the setting. • Treat all staff in a dignified and professional manner, encourage the child to show respect for others both in and out of its obligations Nursery and encourage your child to have a positive attitude to the Nursery. • During busy periods we may ask you due to any event outside its reasonable control. Such events include, without limitation: fire, war, acts of terrorism, strikes or other industrial action, infectious diseases, epidemics, inclement weather (such as snow or flooding), unforeseeable repairs or any failure of public or utility services (such as highway and public transport delays or failures). In the event the nursery applies any discretionary discount to nursery fees, this discount will be solely as a gesture of goodwill and will not constitute any variation of this Parent Agreementfold down your buggy.

The nursery Nursery also reserves the right to terminate or suspend your child’s place, place with immediate effect, if you do not pay the fees Fees by the due date Due Date or you have any outstanding nursery Nursery fees. The nursery Nursery shall be entitled to charge interest (4% above the Bank of England base rate) on any late nursery Nursery fees. We may also charge for all other associated costs related to non-payment or recovery of any nursery Nursery fees. Children in receipt of 15/30 hours free funding require a full terms notice before leaving.

Such events includeinclude without limitation ‘acts of God’, without limitation: fire, war, acts of terrorism, strikes or other industrial action, Government or local authority action: interruption of or interference with the childcare business in consequence of access to the premises being physically hindered or prevented as a result of actions or advise of a government or local authority following an emergency which is likely to endanger human life or property caused directly or indirectly by any infectious diseasesor contagious disease or illness (whether or not present in persons at the premises) or by action taken or advice given to prevent, epidemicsreduce, control or mitigate the outbreak, spread or effects of any infectious or contagious disease or illness, including leading to not enough staff being able to maintain the required staff-child ratio, inclement weather (such as snow or flooding), unforeseeable repairs or any failure of public or utility services services, (such as gas leak or power cut leading to lack of light/heat, highway and public transport delays or failures).
