Common use of NYSERDA Payment Clause in Contracts

NYSERDA Payment. Owner acknowledges that NYSERDA is solely responsible for payment of the NYSERDA Incentive, RG&E shall have no obligation to pay to Owner amounts in respect of the NYSERDA Incentive, and any failure by NYSERDA to pay amounts due under the NYSERDA Agreement shall not relieve Owner of any obligation hereunder.
