Obligation to Diligently Pursue Permits. Wastewater Heat User is responsible for timely obtaining all required permits and approvals. Wastewater Heat User shall use its best efforts to diligently pursue permitting and construction of the Project and Connection by the Milestone Dates set forth in Section 2. Wastewater Heat User’s failure to obtain permitting and/or to commence construction by the Milestone Dates set forth in Section 2 shall be grounds for the County to terminate the Agreement for default under section 11.1.

Wastewater Thermal Energy User shall use its best efforts to diligently pursue permitting and construction of the Project and Connection by the Milestone Dates set forth in Section 2. Wastewater Thermal Energy User’s failure to obtain permitting and/or to commence construction by the Milestone Dates set forth in Section 2 may, in the County’s discretion, be grounds for the County to terminate the Agreement for default under section 11.1.
