Obligation to Issue Licenses. AT&T shall issue a License to Licensee pursuant to this Article 5.1. AT&T and Licensee acknowledge that each Application for a License shall be evaluated on an individual basis. Nothing contained in this section shall be construed as abridging any independent Pole attachment rights or Conduit or Duct access rights which Licensee may have under the provisions of any applicable federal or state laws or regulations governing access to AT&T’s Poles, Conduits and Ducts, to the extent the same are not inconsistent with the Telecommunications Act of 1996.
