Obligation to monitor compliance. ▪ The employer will ensure that its subcontractor complies with and continues to comply with the provisions of clause 10.5.3. ▪ If the employer’s subcontractor is a company that does not carry out the construction/infrastructure activities with its own employees and/or its own organisation, the employer is required to monitor compliance on the part of the party one link lower in the outsourcing chain that employs the personnel who carry out the construction/infrastructure activities.
