Common use of OBLIGATION TO PERFORM FUNCTIONS Clause in Contracts

OBLIGATION TO PERFORM FUNCTIONS. A. Any failure or neglect on the part of OWNER to enforce provisions herein dealing with supervision, control, inspection, testing, or acceptance and approval of the Work shall never operate to relieve Contractor from full compliance with the Contract Documents nor render OWNER liable to Contractor for money damages, extensions of time or increased compensation of any kind.
