Common use of Obligations of County Clause in Contracts

Obligations of County. 4 1. COUNTY shall notify CONTRACTOR of any limitation(s) in COUNTY’s notice of 5 privacy practices in accordance with 45 CFR § 164.520, to the extent that such limitation may affect 6 CONTRACTOR’s Use or Disclosure of PHI. 7 2. COUNTY shall notify CONTRACTOR of any changes in, or revocation of, the permission 8 by an Individual to use or disclose his or her PHI, to the extent that such changes may affect 9 CONTRACTOR’s Use or Disclosure of PHI. 10 3. COUNTY shall notify CONTRACTOR of any restriction to the Use or Disclosure of PHI 11 that COUNTY has agreed to in accordance with 45 CFR § 164.522, to the extent that such restriction 12 may affect CONTRACTOR’s Use or Disclosure of PHI. 13 4. COUNTY shall not request CONTRACTOR to use or disclose PHI in any manner that 14 would not be permissible under the HIPAA Privacy Rule if done by COUNTY.

Obligations of County. 4 1. COUNTY shall notify CONTRACTOR of any restriction to the Use or Disclosure of PHI 11 that COUNTY has agreed to in accordance with 45 CFR § 164.522, to the extent that such restriction may 12 may affect CONTRACTOR’s Use or Disclosure of PHI. 13 4. COUNTY shall not request CONTRACTOR to use or disclose PHI in any manner that would 14 would not be permissible under the HIPAA Privacy Rule if done by COUNTY.
