Common use of Obligations of County Clause in Contracts

Obligations of County. 9 A. COUNTY shall notify INTERMEDIARY of any limitation(s) in COUNTY’S notice of privacy 10 practices in accordance with 45 CFR Section 164.520, to the extent that such limitation may affect 11 INTERMEDIARY’S use or disclosure of PHI. 12 B. COUNTY shall notify INTERMEDIARY of any changes in, or revocation of, permission by 13 an individual client to use or disclose PHI, to the extent that such changes may affect 14 INTERMEDIARY’S use or disclosure of PHI. 15 C. COUNTY shall notify INTERMEDIARY of any restriction to the use or disclosure of PHI that 16 COUNTY has agreed to in accordance with 45 CFR Section 164.522, to the extend that such restriction 17 may affect INTERMEDIARY’S use or disclosure of PHI. 18 D. COUNTY shall not request INTERMEDIARY to use or disclose PHI in any manner that 19 would not be permissible under the Privacy Rule if done by COUNTY. 20

Obligations of County. 9 A. 30 1. COUNTY shall notify INTERMEDIARY CLINIC of any changes in, or revocation of, permission by 13 an individual 12 client to use or disclose PHI, to the extent that such changes may affect 14 INTERMEDIARYCLINIC’S use or disclosure of 13 PHI. 15 14 C. COUNTY shall notify INTERMEDIARY CLINIC of any restriction to the use or disclosure of PHI that 16 COUNTY 15 has agreed to in accordance with 45 CFR Section 164.522, to the extend extent that such restriction 17 may affect INTERMEDIARY16 CLINIC’S use or disclosure of PHI. 18 17 D.
