Common use of Obligations of County Clause in Contracts

Obligations of County. 12 1. COUNTY shall notify INTERMEDIARY of any limitation(s) in COUNTY’s notice of 13 privacy practices in accordance with 45 CFR Section 164.520, to the extent that such limitation may 14 affect INTERMEDIARY’s use or disclosure of PHI. 15 2. COUNTY shall notify INTERMEDIARY of any changes in, or revocation of, permission 16 by an Individual to use or disclose PHI, to the extent that such changes may affect INTERMEDIARY’s 17 use or disclosure of PHI. 18 3. COUNTY shall notify INTERMEDIARY of any restriction to the use or disclosure of PHI 19 that COUNTY has agreed to in accordance with 45 CFR Section 164.522, to the extent that such 20 restriction may affect INTERMEDIARY’s use or disclosure of PHI. 21 4. COUNTY shall not request INTERMEDIARY to use or disclose PHI in any manner that 22 would not be permissible under the Privacy Rule if done by COUNTY.

Obligations of County. 12 33 1. COUNTY shall notify INTERMEDIARY CLINIC of any limitation(s) in COUNTY’s ’S notice of 13 privacy practices 9 in accordance with 45 CFR Section 164.520, to the extent that such limitation may 14 affect INTERMEDIARY’s CLINIC’S use 10 or disclosure of PHI. 15 2. 11 B. COUNTY shall notify INTERMEDIARY CLINIC of any changes in, or revocation of, permission 16 by an Individual individual 12 client to use or disclose PHI, to the extent that such changes may affect INTERMEDIARY’s 17 CLINIC’S use or disclosure of 13 PHI. 18 3. 14 C. COUNTY shall notify INTERMEDIARY CLINIC of any restriction to the use or disclosure of PHI 19 that COUNTY 15 has agreed to in accordance with 45 CFR Section 164.522, to the extent that such 20 restriction may affect INTERMEDIARY’s 16 CLINIC’S use or disclosure of PHI. 21 4. 17 D. COUNTY shall not request INTERMEDIARY CLINIC to use or disclose PHI in any manner that 22 would not be 18 permissible under the Privacy Rule if done by COUNTY.. 19

COUNTY shall notify INTERMEDIARY of any restriction to the use or disclosure of PHI 19 that 20 COUNTY has agreed to in accordance with 45 CFR Section 164.522, to the extent extend that such 20 restriction 21 may affect INTERMEDIARY’s ’S use or disclosure of PHI. 21 4. 22 D. COUNTY shall not request INTERMEDIARY to use or disclose PHI in any manner that 22 23 would not be permissible under the Privacy Rule if done by COUNTY.
