Obtaining a third opinion. If the employee's health care provider disagrees with the determination, a third health care provider will review all pertinent medical records and reports and may examine the employee at either the employee’s or provider’s discretion. This health care provider shall then issue a binding determination that shall be limited to determining whether there is a reasonable expectation that the employee can return to their regularly assigned duties. This health care provider shall be selected from a list previously agreed upon by the Employer/University Administration and the Union. All costs of this examination shall be borne by the employer.
