Common use of Odškodnění Clause in Contracts

Odškodnění. Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including Principal Investigator and co-investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Trial Subject directly caused by use of the Study Product in accordance with the Protocol during the course of the Clinical Trial.

Odškodnění. Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including the Principal Investigator and co-investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Trial Subject directly caused by use of the Study Product in accordance with the Protocol during the course of the Clinical Trial.

Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including Principal Investigator and co-co- investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Trial Subject directly caused by use of the Study Product in accordance with the Protocol during the course of the Clinical Trial.

Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including Principal Investigator and co-investigators) (together as “Indemnitees on the Institution's side”) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Trial Subject directly caused by use of the Study Product in accordance with the Protocol or in connection with any procedure performed in accordance with the Protocol during the course of the Clinical Trial.

Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including the Principal Investigator and co-investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Trial Subject directly the extent caused by use of the Study Product Janssen’s negligence or willful misconduct in accordance connection with the Protocol during the course of the Clinical Trialthis Agreement.

Janssen shall defend, indemnify and hold harmless Institution, its trustees, officers, agents and employees (including Principal Investigator and co-investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury injury, including death, to a Trial Subject directly caused by use of the Study Product in accordance with the Protocol during the course of the Clinical Trial or any properly performed intervention or procedure provided for or required by the Protocol to which the Trial Subject would not have been exposed but for their participation in the Clinical Trial.

Janssen shall defend, indemnify and hold harmless InstitutionProvider, its trustees, officers, agents and employees (including Principal Investigator and co-investigators) from any and all losses, costs, expenses, liabilities, claims, actions and damages, based on a personal injury to a Clinical Trial Subject patient directly caused by use of the Study Product in accordance with the Protocol during the course of the Clinical TrialServices.
