Common use of One-Year Warranty Clause in Contracts

One-Year Warranty. In addition to the warranties and guarantees set forth elsewhere in this Contract, the DB, upon request by the Owner, shall promptly correct all failures or defects in the Work for a period of one (1) year after the actual date of Substantial Completion, or the date of acceptance by the Owner, whichever is later. 13.1.1 The DB shall schedule, coordinate and participate in a walk-through inspection of the Work one (1) month prior to the expiration of the one-year correction period, and shall notify the Owner and any necessary subcontractors and suppliers of the date of, and request their participation in, the walk-through inspection. The purpose of the walk- through inspection will be to determine if there are defects or failures which require correction. 13.1.2 Should the DB fail to promptly correct any failure or defect, the Owner may take whatever actions it deems necessary to remedy the failure or defect and the DB shall promptly reimburse the Owner for any expenses or damages it incurs as a result of the DB’s failure to correct the failure or defect.
