Common use of Operation as a Public Airport Clause in Contracts

Operation as a Public Airport. The Authority covenants and agrees that all times it will operate and maintain the Airport, as a public Airport consistent with and pursuant to the sponsor’s assurances given by the Authority to the United States Government under the Federal Aviation Act.

Operation as a Public Airport. The Authority covenants and agrees that all times during the term hereof it will operate and maintain the AirportAirport and its public Airport facilities, as defined hereinabove, as a public Airport airport consistent with and pursuant to the sponsor’s assurances given by the Authority to the United States Government under the Federal Aviation Airport Act. Thereafter, the Authority may, but shall not be obligated to, maintain the Airport under the terms of this lease.

Operation as a Public Airport. The Authority covenants and agrees that at all times it will operate and maintain the AirportAirport facilities, as defined hereinabove, as a public Airport airport consistent with and pursuant to the sponsor’s assurances Sponsor's Assurances given by the Authority to the United States U.S. Government under the Federal Aviation ActAirport Act and consistent with the terms and conditions of this Agreement. The Authority further covenants and agrees to manage the Airport in a reasonable and prudent manner and to use due diligence in the operation and maintenance of Airport facilities.
